Article 1 – Definitions
- Trader: BAM! Deals B.V., trading under the trade names BAM! Deals B.V., BAM! Deals, BAM! Distributie and BAM! Mining and via the website bamdeals.nl.
- Consumer: a natural person who is not acting for purposes relating to their trade, business, craft or profession.
- Deal: a temporary offer of a product or service at a promotional price, with a limited duration and/or limited stock.
- Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
- Distance contract: a contract concluded without the simultaneous physical presence of both parties, using only means of distance communication.
- Day: calendar day.

Article 3 – Applicability
These terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
Before the distance contract is concluded, the text of these terms is made available to the consumer. If this is not reasonably possible, the trader will indicate how the terms can be viewed and that they will be sent free of charge on request.
If one or more provisions of these terms are void or annulled, the remaining provisions remain in force.
Article 4 – The offer
An offer contains a complete and accurate description of the products offered. Images are a true representation, but obvious mistakes or errors do not bind the trader.
Deals are valid for their stated duration and/or while stocks last (gone = gone). Each deal clearly states until when it is valid.
Any recommended or comparison price is the price used by the trader or manufacturer in the 30 days prior to the deal, or the price common in the market, and is displayed fairly and verifiably.
Article 5 – The contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions. The trader confirms receipt of the order by email without delay.
The trader takes appropriate technical and organisational measures to secure the electronic transfer of data and provides a secure payment environment.
If a deal is unexpectedly sold out at the time of ordering, or in the event of an obvious pricing error, the trader has the right to cancel the order. Any amounts already paid will be refunded within 14 days.
Article 6 – Right of withdrawal
The consumer can cancel a contract for the purchase of a product within a cooling-off period of 14 days without giving any reason. The cooling-off period starts on the day after the consumer, or a third party designated by the consumer, has received the product.
During the cooling-off period the consumer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to establish its nature, characteristics and functioning.
The consumer is only liable for any decrease in the value of the product resulting from handling it beyond what is permitted above.

Article 7 – Obligations on withdrawal
If the consumer exercises their right of withdrawal, they notify the trader within the cooling-off period, for example by email or using the model withdrawal form.
The consumer returns the product as soon as possible, but within 14 days of the notification. The direct cost of returning the product is borne by the consumer, unless stated otherwise.
The trader refunds all payments made by the consumer, including any delivery costs for standard delivery, within 14 days of the notification of withdrawal. The trader may withhold the refund until the product has been received or the consumer proves it has been returned.
The trader uses the same payment method the consumer used for the refund, unless the consumer agrees to another method.
Article 8 – Exclusion of the right of withdrawal
The trader may exclude the following products from the right of withdrawal, provided this is clearly stated in the offer:
- products made to the consumer's specifications or clearly personalised;
- products that spoil quickly or have a limited shelf life;
- sealed products that are not suitable for return for health protection or hygiene reasons and whose seal has been broken after delivery;
- sealed audio or video recordings and computer software whose seal has been broken after delivery.
Article 9 – Price
During the term of a deal, the prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates.
All prices are in euros and include VAT. Any shipping costs are clearly stated before the order is completed.
Article 10 – Conformity and warranty
The trader guarantees that the products comply with the contract, the specifications stated in the offer, reasonable requirements of soundness and usability, and the statutory provisions in force on the date the contract was concluded.
Any additional warranty provided by the trader, manufacturer or importer never limits the statutory rights and claims the consumer has against the trader under the contract.
Defects must be reported within two months of discovery.
Article 11 – Delivery and performance
The trader takes the greatest possible care when receiving and executing orders. The place of delivery is the address the consumer has provided to the trader.
Accepted orders are executed promptly, but no later than within 30 days, unless a different delivery period has been agreed. In the event of a delay, the consumer will be notified no later than 30 days after ordering and has the right to cancel the contract free of charge.
The risk of damage and/or loss of products rests with the trader until the moment of delivery to the consumer. More information on delivery times can be found on Shipping & returns.
Article 12 – Payment
The consumer pays the amount due when completing the order using one of the payment methods offered, such as iDEAL, credit card or Bancontact.
The consumer must report any inaccuracies in payment details provided or stated to the trader without delay.
Article 13 – Complaints procedure
Complaints about the performance of the contract must be submitted to the trader in good time, fully and clearly described, via info@bamdeals.nl.
Complaints submitted to the trader will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, the consumer will receive an acknowledgement within 14 days and an indication of when a more detailed answer can be expected.
Article 14 – Disputes and applicable law
Contracts between the trader and the consumer are governed exclusively by Dutch law. This does not affect the mandatory consumer protection of the country where the consumer lives.
